Opgericht op 15 februari 1950 onder de Wet op de Bedrijfsorganisatie. Sinds de afschaffing van de publiekrechtelijke bedrijfsorganisatie (PBO) in 2015 is het kernstatuut de SER-wet.

De SER adviseert de regering en het parlement over sociaal-economisch beleid. Uniek in haar samenstelling: 11 werkgevers- + 11 werknemers-vertegenwoordigers + 11 onafhankelijke kroonleden. Advies is (vaak) 'unaniem' en heeft daardoor veel politiek gewicht. Circa 100 FTE, hoofdkantoor Den Haag.
